This Privacy Policy is to indicate how the data of users using this website, hereinafter referred to as “Users”, are processed and protected, in particular with regard to the collection and processing of personal data and the collection and use of cookies, hereinafter referred to as “Data”.


I. General Information

The Administrator of User Data is Polska Grupa Biogazowa with its registered office in Warsaw, ul. Gotarda 9, 02-793 Warsaw, registered in the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000479209, having tax identification number NIP 5213656247, assigned by the Statistical Office with identification number REGON 146892650, with the share capital of PLN 40,100,000, hereinafter referred to as the “Company”.
Due to the small scope of data collection or processing, the Company has not appointed a Personal Data Inspector. For all matters relating to the Privacy Policy, contact us at pgbiogaz@pgbiogaz.pl.

Through the Company’s website, Users can learn about the details of its operations, planned projects or current career opportunities at the Company.

In order to gain access to the Company’s website, the User needs at least:
a) Internet connection;
b) access to a web browser.
 

a) LEGAL AND FACTUAL BASIS
 
This Privacy Policy corresponds to the actual scope and needs of the collection and processing of Users’ personal data by the Company and the applicable laws, in particular:

1. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data 95/46/EC (GDPR);

2. Act of 10 May 2018 (Journal of Laws of 2019, item 1781) on personal data protection;

3. Act of 16 July 2004 (Journal of Laws of 2019, item 2460) Telecommunications Law.


II. Data to be collected and the purpose of their processing


1. Due to the functionalities of the Company’s website, the Company will collect personal data of the Users, such as: Internet identifier, location data or identification number, which allows identification of the User, as well as other non-personal information. Since the GDPR states that the above data constitute personal data and are subject to the protection provided by the GDPR, the Company has covered them in this Privacy Policy.

2. Data may be processed for the purpose of the Company’s website administration. Such data will be saved automatically on the server each time the User uses the Company’s website. The User data that can be collected and processed include:
– IP address;
– server date and hour;
– information about the web browser;
– information about the operating system.
Data processed in accordance with Article 6(1)(f) GDPR.

3. Data may be processed for the purpose of analysing and researching activity on the Company’s website. Google Analytics tools are used for this purpose in accordance with the terms and conditions and the Google privacy policy available at: https://policies.google.com/privacy The User data that can be collected and processed include:
– date and time of visits to the website;
– operating system type;
– approximate location;
– type of web browser used to browse the site;
– duration of time spent on the site;
– subpages visited;
– subpage where the contact form was completed.
Data processed in accordance with Article 6(1)(f) GDPR.

4. Data may be processed in order to collect cookies referred to in section III of the Privacy Policy. Data processed in accordance with Article 6(1)(a) GDPR.


III. Cookies


1. On its website, the Company uses cookies, i.e. short text data files, saved on a computer, phone, tablet or other device of the User. They can be read by the Company’s system as well as systems belonging to third parties whose services are used by the Company.

2. Cookies meet the following objectives on the Company website:

a) ensuring security – cookies are used to authenticate Users and prevent unauthorized use, thus protecting Users’ personal data against unauthorized access;

b) impact on the processes and efficiency of website use – cookies are used to ensure the smooth operation of the Company’s website and to make full use of its functionality, which is possible, among other things, by memorizing settings between subsequent visits to the website;

c) session status – information on how Users use the website is stored in cookies; they also facilitate identification of errors displayed on some subpages. Cookies used to store session status data are used to improve services and increase the quality of browsing;

d) creating statistics and analyses – cookies are used to analyse how Users use the website. We use this information to constantly improve the website and adjust its operation to the Users’ preferences.

We use Google Analytics tools to track activity and generate statistics, in accordance with the Google Analytics terms of use and privacy policy available at: https://policies.google.com/privacy

3. By default, the User’s web browser allows the use of cookies in the User’s device, whereby during the visit to the Company’s website, the User will be asked to agree to the use of cookies. However, if the User does not allow the use of cookies when browsing the website, they can change the settings in their browser – completely blocking the automatic handling of cookies or requesting notification each time cookies are stored on their device. The User can change their settings at any time.

4. The User delete cookies at any time by selecting the functions available for their web browser. Please be advised that disabling or limiting the use of cookies may cause difficulties in using the Company website.


IV. Data recipients

1. In order to ensure the continuity of the Company’s website and the security of its operation, the Data may be made available to authorized employees, associates of the Company or its subcontractors, such as providers of data centres or IT services, and any other entities assisting us in meeting the objectives referred to in Section III of the Privacy Policy.

2. In justified cases, Data may be disclosed to third parties who have been authorised in this respect under applicable law or by decision of a competent authority.

3. The Company may use third party tools that may collect User Data, such as Google Analytics, to operate the website and to create analyses of its operation in accordance with this Privacy Policy.

4. The Company will not transfer or permit the transfer of any User Data in territories outside the European Economic Area unless it takes the necessary measures to ensure that such transfer complies with applicable laws. The appropriate level of protection of User Data is ensured by the participation of these entities in the European Economic Area or in the EU-US Privacy Shield, established by an implementing decision of the European Commission as a set of principles guaranteeing adequate protection of the User’s privacy.


V. User rights

1. The User has the right to:
a/ access their personal data;
b/ correct their personal data;
c/ delete their personal data;
d/ restrict the processing of their personal data;
e/ object to the processing of their personal data;
f/ transfer their personal data.

2. In justified cases, the Company will have the right to deny the User access to the Data or refuse to take into account the objection to the processing of personal data.

3. The User may exercise the rights referred to in point 1 through applications sent directly to the Company’s registered office or e-mail address: pgbiogaz@pgbiogaz.pl.


VI. Requirement of data transfer by the User and the period of data processing

1. Non-personal information is collected automatically during the use of the Company’s website using cookies or other tracking technologies. It should be noted, however, that in some situations the collection of User Data in this way by the Company is necessary to ensure full functionality of the Company’s website.

2. The Company will store and process User Data only for as long as it has the legal basis to do so.


VII. User’s right of complaint

If the User believes that their Personal Data are processed illegally, the User may lodge a complaint with the President of the Office for Personal Data Protection.


VIII. Final Provisions

1. To the extent not regulated by this Privacy Policy, the relevant provisions of Polish law shall apply.

2. Any changes made to this Privacy Policy will be made public on the Company’s website each time.

3. This Privacy Policy is effective from 23 June 2020.
